Eligibility and Acceptable Use

Users must be legally capable of entering into binding contracts in their jurisdiction and must use nunusala services for lawful purposes. Use that violates applicable law, third-party rights, or these terms is prohibited.

Services are not intended for users under 13 years of age. If you are under the legal age to form a contract in your jurisdiction, you may not register for or use services without the involvement of a parent or guardian.

You must not use nunusala services to develop, deploy, or distribute unlawful content, malware, spam, or any application or workflow that facilitates illegal activity. Users remain responsible for ensuring that their use complies with industry-specific regulations and local laws.

Access to certain features may be limited by export controls, sanctions, or local regulations. It is your responsibility to ensure that your use of the services is permitted in your jurisdiction.

Account Terms

Certain parts of nunusala services may require an account. Account registration requires accurate and current information. You are responsible for maintaining the confidentiality of account credentials and for all activity under your account.

You agree to provide accurate information and to update account information promptly if it changes. Inaccurate or incomplete information may limit your access to features and support.

Protect your login credentials and use secure practices. Notify nunusala immediately if you suspect unauthorized access. We implement reasonable measures to protect account data but cannot ensure absolute security.

Accounts are personal and may not be transferred or sold without explicit written consent from nunusala.

If you suspect your account has been compromised, contact support immediately at +66961217802 or via the contact channels on nunusala.digital so we can take appropriate action to secure the account.

nunusala may suspend or restrict access to accounts that violate these terms or where continued access poses a security risk. We will notify affected users where practicable.

Services

nunusala provides software development, AI model integration, consulting, and deployment services to help organizations adopt AI capabilities. Services may include custom software, APIs, integration work, training datasets preparation, and operational guidance. Scope and deliverables are defined in written agreements for each engagement.

We may update, modify, or discontinue features of the services. Where changes materially affect a contracted scope of work, we will coordinate with clients according to the terms of the applicable service agreement.

We aim to provide reasonable availability for hosted services, but do not warrant uninterrupted or error-free operation. Maintenance windows and scheduled downtime may be necessary for updates and security patches.

Rules of Use

When using nunusala services you agree to the following rules and restrictions:

• Do not attempt to circumvent access controls, security features, or usage limits implemented by nunusala.
• Do not upload, transmit, or process content that infringes third-party rights, is defamatory, or is otherwise unlawful.
• Do not use services to create or distribute malware, phishing content, or unsolicited commercial messages.
• Comply with export control, data protection, and privacy laws applicable to your use of the services.
• Do not impersonate individuals or falsely represent affiliation with any person or organization.
• Follow instructions and safeguards provided by nunusala for secure integration and operation of AI systems.
• Respect rate limits, API usage policies, and any resource quotas specified in your agreement.

User Content

User content means any data, text, files, or other information you provide or submit to nunusala services. You are responsible for the content you provide and must ensure you have rights to submit it.

You retain ownership of your user content unless otherwise agreed in a separate written contract. We do not claim ownership over your data.

By submitting content to nunusala for processing or hosting, you grant nunusala a non-exclusive, limited license to use, store, transmit, and process that content as necessary to provide the requested services, support, and troubleshooting.

You are responsible for backups and for ensuring that submitted content does not violate applicable law or third-party rights. nunusala may remove content that violates these terms or applicable law.

If you request removal of user content, nunusala will take commercially reasonable steps to delete the data from active systems within a reasonable period, subject to retention requirements, backups, and contractual obligations.

Intellectual Property

nunusala retains ownership of its pre-existing intellectual property, platform technology, codebases, and tools. Deliverables produced under a paid engagement will be governed by the applicable contract which specifies ownership, licensing, and use rights.

• You may not reverse engineer, decompile, or disassemble nunusala software except as permitted by applicable law.
• You may not remove, obscure, or alter intellectual property notices on software or documentation provided by nunusala.
• Use of nunusala activity and service marks requires prior written permission.

Paid Services

Paid services include custom development, consulting, hosting, and managed services as described in individual statements of work or service agreements.

Pricing for paid services is set out in quotes or agreements and may be based on project scope, time and materials, or subscription models. All pricing is quoted in the currency specified in the agreement.

Payments are due according to the schedule in the applicable agreement. Accepted payment methods will be specified in the invoice. Late payments may incur suspension of services until payment is received.

Subscription services run for the subscription term set out in your agreement and renew according to the renewal terms. Users are responsible for timely cancellation if they do not wish to renew.

Refunds, if any, are handled in accordance with the terms of the relevant agreement and applicable consumer protection laws. Refund eligibility depends on the nature of the service and work performed.

Cancellation terms, including required notice periods and any applicable fees, are specified in the service agreement. Termination does not relieve you of payment obligations for completed work.

You are responsible for any taxes, duties, or charges arising from your use of paid services, excluding taxes on nunusala's net revenue where required by law.

We may adjust pricing for services on renewal or under a new agreement. Price changes for ongoing subscriptions will be communicated in advance as required by the agreement.

Non-payment may result in suspension or termination of services and may incur collection costs. We will attempt to provide notice before suspension where practicable.

Disclaimer

nunusala provides services and information on an as-is basis. Information provided through the website or services is for general informational purposes and technical guidance. Results of AI systems depend on input data, implementation, and operational context; outcomes may vary and are not promised.

Limitation of Liability

To the extent permitted by law, nunusala's liability for damages arising out of or in connection with the services is limited to direct damages up to an amount specified in the applicable agreement. nunusala is not liable for indirect, special, incidental, or consequential damages, loss of benefits, or loss of data.

Third-Party Services and Software

The services may integrate third-party tools, libraries, or cloud providers. Use of third-party components is subject to their respective terms and privacy policies. nunusala is not responsible for third-party service performance or actions.

Termination

Either party may terminate an agreement in accordance with its termination provisions. nunusala may suspend or terminate access for violation of these terms or for non-payment. Upon termination, obligations that by their nature survive termination will remain in effect.

Termination may result in loss of access to data and services. You are responsible for exporting any required data before termination; nunusala may retain copies as required by law or for legitimate business purposes.

Privacy and Data Protection

nunusala processes personal data in accordance with the privacy notice available on our website. Data processing for service delivery will be performed under applicable data protection laws and contractual safeguards. Clients and users should review the privacy notice for details on rights and processing practices.

Communications

By providing contact details, you consent to receive service-related communications, including administrative messages and updates. Marketing communications will be sent only with consent where required by law, and you may opt out as described in the privacy notice.

Changes to Terms

nunusala may revise these terms from time to time. Material changes will be posted on the website with the updated effective date. Continued use after changes indicates acceptance of the updated terms for continuing services.

Governing Law

These terms and any disputes arising from them are governed by the laws of Thailand. Parties agree that courts located in Nakhon Si Thammarat, Thailand, will have jurisdiction to resolve disputes, subject to applicable mandatory rules.

Dispute Resolution

If a dispute arises, parties should first seek to resolve it through good faith discussions. If unresolved, disputes will be handled in accordance with the dispute resolution provisions in the applicable agreement or, absent such provisions, under the jurisdiction specified above.
